Terms of Service

KAPEHORN Inc. Terms of Service

These Terms of Service (the "Terms") form a binding agreement between you and KAPEHORN Inc. ("Kapehorn", "we", "us", or "our") regarding your use of RUNuts, our virtual reality multiplayer game distributed through the Meta Horizon Store, and our website at runutsvr.com (together, the "Services").

By installing, accessing, or using the Services, you accept these Terms. If you do not accept these Terms, do not use the Services.


1. Privacy Policy

Your use of the Services is also governed by our Privacy Policy at runutsvr.com/privacy-policy. The Privacy Policy is incorporated into these Terms by reference.


2. Eligibility and Age Requirements

RUNuts is intended for players aged 13 and older. We also support younger players (ages 10 to 12) only through Meta's Parent-Managed Account system.

2.1 Age 13 and Older

You may use RUNuts on your own behalf if you are at least 13 years old. By accepting these Terms, you represent that you meet this age requirement.

2.2 Age 10 to 12 — Parent-Managed Accounts Only

A player aged 10 to 12 may use RUNuts only when:

• the player accesses RUNuts through a Meta Parent-Managed Account that the parent or legal guardian has set up; and
• the parent or legal guardian has approved RUNuts for download.

If a player aged 10 to 12 accesses the Services without a Parent-Managed Account, we may, upon discovery, ban the account and delete the player's information.

2.3 Under 10

We do not permit children under 10 to use the Services.

2.4 Parents and Legal Guardians

If you are a parent or legal guardian and you accept these Terms on behalf of a child between 10 and 12, you (a) represent that you are the parent or legal guardian, (b) agree to these Terms on the child's behalf, and (c) accept responsibility for the child's compliance with these Terms and for any liability arising from the child's use of the Services.

2.5 Legal Age of Majority

If you are between 13 and the legal age of majority in your country (typically 18 or 19), you may use the Services only with the involvement of your parent or legal guardian, who is responsible for your compliance with these Terms.


3. Your Account

3.1 Meta Account Requirement

RUNuts requires a valid Meta account on a supported Meta Quest device. Account creation and authentication are administered by Meta. We do not control the availability of Meta accounts.

3.2 Account Responsibility

You are responsible for all activity that occurs under your account, whether or not you authorized it. You agree to:

• maintain control of your Meta account credentials
• promptly notify us of any unauthorized use
• not allow anyone else to use your account
• not use anyone else's account

3.3 Account Sharing

You agree not to sell, buy, trade, lease, or share your RUNuts account.


4. License to Use the Services

Subject to your compliance with these Terms, we grant you a personal, non-exclusive, non-transferable, revocable, limited license to access and use the Services for personal entertainment purposes.

You may not:

• copy, modify, distribute, sell, rent, sublicense, or create derivative works of the Services (except as expressly permitted in Section 9 for content creation and broadcasting)
• reverse engineer, decompile, or disassemble the Services
• circumvent technical protection measures
• use the Services to provide a competing product or service


5. In-App Purchases and Virtual Currency

5.1 Golden Nuts and Virtual Items

RUNuts offers virtual currency called "Golden Nuts" and other virtual items. Virtual currency and items have no real-world value, are licensed to you (not sold), and are limited to use within RUNuts.

5.2 Payment and Refunds

All purchases of Golden Nuts and other virtual items are processed by Meta through the Meta Horizon Store. Payment terms, refund eligibility, and dispute resolution for purchases are governed by Meta's policies. Kapehorn cannot issue refunds for in-app purchases. Please contact Meta Support for refund requests.

5.3 Non-Transferability

Virtual currency and items are tied to your Meta account and cannot be transferred, sold, traded, gifted, or otherwise assigned to another account or person. Real-world money trading (RMT) of accounts, currency, or items is strictly prohibited.

5.4 No Guarantee

We do not guarantee that any specific virtual item, currency amount, event, or feature will continue to exist or be available. We may modify, suspend, or remove virtual items at any time. If we permanently discontinue RUNuts, virtual items and currency will cease to be usable.

5.5 Account Termination

If your account is suspended or terminated for violation of these Terms, you forfeit access to your virtual currency and items, and you are not eligible for refunds.


6. User Conduct

You agree not to use the Services to:

• Harassment: harass, threaten, bully, intimidate, stalk, or harm any person; engage in hate speech, including discrimination based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or veteran status


• Personal information: share another player's personal information without their consent ("doxxing"), or threaten to do so


• Voice misuse: shout, scream loudly with intent to cause discomfort, use voice chat to harass, broadcast offensive recordings, or impersonate others through voice


• Sexual content: engage in sexually explicit, suggestive, or predatory behavior; sexually solicit other users; share or describe sexual content involving minors (which we will report to law enforcement)


• Cheating and exploits: use cheats, bots, automated software, third-party mods or injectors, exploit bugs or glitches that degrade the experience of other players, or otherwise gain unfair advantage


• Account abuse: share, sell, buy, or trade accounts; falsify your age; use VPNs or geolocation spoofing to bypass regional restrictions; create multiple accounts to evade bans


• Disruption: spam, flood, intentionally disrupt matches, hold rooms hostage, or interfere with our servers or other users' experience


• Impersonation: impersonate Kapehorn employees, moderators, Meta representatives, government officials, or other persons


• Promotion: promote scams, phishing, or fraudulent schemes; this rule does not restrict legitimate content creation and broadcasting governed by Section 9


• Illegal activity: engage in any activity that violates applicable law

This list is not exhaustive. We may take action against any conduct that we reasonably consider harmful to the community or to the Services.


7. Reporting, Moderation, and Enforcement

7.1 In-Game Reporting

You can report another player's misconduct through the in-game report feature, accessible from the player list or system menu. When you submit a report, we may receive a short audio clip of the reported player's recent voice activity for review (see Section 5 of the Privacy Policy).

7.2 Mute and Block

You can mute or block any other player at any time to manage unwanted interactions.

7.3 Enforcement Actions

We may take any of the following actions against an account that violates these Terms or our Community Guidelines:

• warning
• temporary suspension
• permanent ban
• restriction of specific features (such as voice chat or matchmaking)
• removal of cosmetic items, currency, or progression earned through violations
• report to Meta or to law enforcement, where the conduct is unlawful or threatens the safety of others

We may take these actions in our reasonable discretion, with or without prior notice.

7.4 Appeals

If you believe an enforcement action against your account was unjustified, you may appeal by emailing helper@kapehorn.io with the subject line "Ban Appeal" and your Meta User ID. We aim to respond to appeals within 14 days. Decisions on appeals are final.

7.5 No Obligation to Monitor

We have no obligation to monitor user conduct or content. We may, in our discretion, monitor for the purposes of enforcement and safety as described in our Privacy Policy.


8. Intellectual Property

8.1 Our Rights

RUNuts and all of its content, including but not limited to artwork, characters, environments, music, sound effects, code, branding, and trademarks, are owned by Kapehorn or its licensors and are protected by copyright, trademark, and other intellectual property laws. The license in Section 4 does not transfer any ownership to you.

8.2 Feedback

If you send us feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable license to use the feedback for any purpose without compensation or attribution.


9. Content Creation, Streaming, and Broadcasting

We welcome and encourage the content creator community. You may capture, record, stream, and post videos, screenshots, and other media of your RUNuts gameplay, for both personal and commercial purposes, including:

• live streams on Twitch, YouTube, Kick, Meta's streaming features, and similar platforms
• video uploads to YouTube, TikTok, Instagram, X, and similar platforms
• monetized content (advertising revenue, channel subscriptions, tips, donations)
• sponsored content (so long as you are not endorsing Kapehorn or RUNuts without permission)
• educational, news, review, or commentary content
• inclusion of your gameplay clips in third-party compilations or partnerships

This permission is granted under the following conditions:

9.1 Respect Other Players

Do not publish another player's voice, real name, real-world identity, or other personal information without their consent. If a player you recorded asks you to remove or edit footage that contains them, please do so within a reasonable time. This protection does not extend to in-game nicknames visible during normal play.

9.2 No Misrepresentation

Do not present your content as official RUNuts or Kapehorn content, and do not imply that Kapehorn sponsors or endorses your channel without our prior written permission. If you have a brand partnership that uses RUNuts, you must disclose the sponsorship in line with the rules of the platform you publish to.

9.3 Follow Our Conduct Rules and Platform Rules

The User Conduct rules in Section 6 still apply when your gameplay is being streamed or recorded. Your content must also comply with the terms of the platform on which it is published.

9.4 Reservation of Rights

We may, in our reasonable discretion, request removal of specific content that violates these Terms or that materially harms the RUNuts community. We will not require removal of legitimate review, news, or commentary content based solely on negative opinion.

For brand partnerships, esports licensing, or other official collaborations involving RUNuts, contact us at runuts@kapehorn.io.


10. Health and Safety

Virtual reality involves physical movement and visual immersion. Please read and follow these precautions.

10.1 Photosensitive Seizures and Motion Sickness

A small percentage of people may experience seizures or significant motion sickness when exposed to flashing lights, patterns, or simulated motion, even without prior history. Stop playing immediately and consult a doctor if you experience symptoms such as dizziness, nausea, altered vision, eye or muscle twitching, loss of awareness, disorientation, convulsions, or involuntary movements. Do not drive, operate machinery, or engage in activities requiring focus until any symptoms have resolved.

10.2 Play Area and Supervision

A clear play area of at least 6.5 feet by 6.5 feet (2 meters by 2 meters) free of furniture, sharp objects, stairs, glass, and other hazards is recommended, with adequate overhead clearance. Be aware that the headset blocks your view of the physical environment. Keep audio at a level that allows you to remain aware of your surroundings. A parent or legal guardian should supervise a child user's VR play sessions.

10.3 Breaks, Fatigue, and Health Conditions

Take a 10- to 15-minute break every 30 minutes of play. Stop playing if your hands, wrists, eyes, neck, or head become uncomfortable. Do not use the Services if you are tired, under the influence of alcohol or drugs, hungover, or under emotional stress. If you are pregnant, elderly, or have a pre-existing condition that may be affected by physical activity, strobing visuals, or VR, consult a doctor before playing.

10.4 Assumption of Risk

You acknowledge that you use the Services at your own risk. To the fullest extent permitted by law, Kapehorn is not liable for any injury, illness, or property damage resulting from your VR use.


11. Disclaimers

To the fullest extent permitted by applicable law, the Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, statutory, or otherwise, including without limitation warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, reliability, or uninterrupted availability.

We do not warrant that:

• the Services will meet your requirements
• the Services will be uninterrupted, error-free, or secure
• defects will be corrected
• the content available in the Services will be accurate or complete

You assume all risks associated with your interactions with other users. We do not screen, verify, or vet users.


12. Limitation of Liability

To the fullest extent permitted by applicable law, Kapehorn and its officers, employees, agents, licensors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, lost goodwill, business interruption, or any similar damages, whether based in contract, tort (including negligence), or any other legal theory, and whether or not Kapehorn has been informed of the possibility of such damage.

Our total cumulative liability arising out of or relating to these Terms or the Services will be limited to the maximum extent permitted by applicable law.

Some jurisdictions do not allow the exclusion or limitation of certain damages. To the extent such exclusions or limitations are not enforceable in your jurisdiction, the foregoing limitations will apply to the maximum extent permitted by applicable law, and nothing in these Terms limits any liability that cannot be limited under applicable law.


13. Indemnification

You agree to indemnify, defend, and hold harmless Kapehorn and its officers, employees, agents, licensors, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• your use of the Services
• your violation of these Terms
• your violation of any rights of another party
• your conduct toward other users


14. Termination

14.1 By You

You may stop using the Services at any time. You may request deletion of your account by emailing helper@kapehorn.io.

14.2 By Us

We may suspend or terminate your access to the Services, with or without notice, at any time, for any reason, including for violation of these Terms.

14.3 Effect of Termination

Upon termination:

• your license to use the Services ends
• you may lose access to virtual currency, items, and account progression
• you are not entitled to refunds
• provisions of these Terms that by their nature should survive termination (including Sections 5.4, 8, 11, 12, 13, 15, and 16) will survive


15. Dispute Resolution

15.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact us at helper@kapehorn.io to attempt good-faith resolution. We will attempt to resolve disputes informally within 60 days of receipt of your notice.

15.2 Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services that is not resolved informally will be subject to the exclusive jurisdiction of the Seoul Central District Court. Nothing in this Section affects any mandatory consumer protections that you have under the laws of your country of residence.

 

15.3 Time Limit

You must bring any claim arising out of or relating to these Terms or the Services within one (1) year after the claim arose, except where applicable law requires a longer period.


16. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top and may also provide additional notice (such as an in-game message or email). Material changes will take effect no earlier than 30 days after notice, except where a shorter notice period is required by law or by changes to applicable platform policies. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.


17. Miscellaneous

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Kapehorn regarding the Services.

 

17.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force.

 

17.3 No Waiver

Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

 

17.4 Assignment

You may not assign these Terms without our prior written consent. We may assign these Terms freely.

 

17.5 Language

These Terms are provided in English. If we provide a translation, the English version controls in case of conflict, unless a translated version is required by applicable consumer-protection law.
